OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE IN THE MET ART LINKS GAME  (THE “GAME”) AND/OR THE MET ART LINKS REWARDS GIVEAWAY PROMOTION (THE “PROMOTION”), OR TO RECEIVE ANY REWARDS IN CONNECTION WITH THE GAME AND/OR PROMOTION. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING THE GAME OR RECEIVING REWARDS IN THE PROMOTION.  GAME IS VOID WHERE PROHIBITED BY LAW.

The Met Art Links Game starts at 10:00 AM Eastern Time (ET) on January 23rd, 2025 and will continue indefinitely until a date to be determined in the future (the “Game Period”); in no event will Game Play end before the end of the Promotion Period (as defined below). The Metropolitan Museum of Art (the “Met” or “Sponsor”) and/or TRLab US Inc. (“Administrator”) (together, the “Game Entities”) will post notice through the Game no less than one month in advance of when Game Play will terminate.  The associated Met Art Links Rewards Giveaway Promotion will also begin at 10:00 AM Eastern Time (ET) on January 23rd, 2025; the Giveaway will end at 11:59:59 PM ET on April 16th, 2025 (the “Promotion Period”); the Giveaway Promotion is subject to separate Promotion Rules that can be found at https://cdn.trlab.com/the-met/rules/rewards_giveaway_promotion.html.

These Game Rules (“Game Rules” or “Terms and Conditions” or “Terms”) govern the play of The Met Art Links Game, the receipt of Rewards as a result of Game play, and The Metropolitan Museum of Art’s (“Sponsor’s”) relationships with Game participants (each, a “Player,” and collectively, “Players”). Your participation in the Game is expressly conditioned upon your compliance with these Game Rules and with all present and future rules, terms, regulations, policies and procedures that Sponsor and Administrator may, in their discretion, adopt from time to time. In addition, by enrolling or participating in the Game and/or the Promotion, you acknowledge and agree to Sponsor’s Privacy Policy  and Website Terms and Conditions, and Administrator’s Privacy Policy (“Privacy Policy”)  and Terms of Service, each of which are incorporated herein by reference.  

BY ENROLLING OR PARTICIPATING IN THE GAME, YOU ARE AGREEING TO BE LEGALLY BOUND BY THESE GAME TERMS AND CONDITIONS AND ALL RELATED AGREEMENTS INCORPORATED BY REFERENCE, INCLUDING THE PROMOTION RULES IF YOU CHOOSE TO ENTER THE PROMOTION. 1. SPONSOR: This Game is sponsored by The Metropolitan Museum of Art (“The Met”). 1000 5th Avenue, New York NY and administered by TRLab US Inc., 99 Hudson Street, 5th Floor, PMB 7267, New York NY (together, the “Game Entities”). References in these Game Terms to “we”, “us” or “our” are references to the Game Entities. Any references to “you” or “your” in these Game Terms will mean the Player enrolling or participating in the Game.

THIS GAME IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH META PLATFORMS, INC. (INCLUDING INSTAGRAM), OR ANY OTHER THIRD-PARTY SOCIAL MEDIA PLATFORM THAT MAY BE ACCESSED IN CONNECTION WITH THE GAME.

2. ELIGIBILITY: The Game is open to individuals who are at least eighteen (18) years of age or older at the time of their participation in the Game. Employees, officers, and directors of the Game Entities and their parents, subsidiaries, affiliates, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies and members of their immediate families (spouses, parents, siblings and children, regardless of where they live), and those living in the same household are eligible to play the Game, but will not be eligible to earn or receive Rewards (as defined below) in the associated Promotion. The Game Entities reserve the right to verify the eligibility of any Player. Participation constitutes Player’s full and unconditional agreement to these Game Rules and to the Game Entities’ decisions, which are final and binding in all matters related to the Game.

Any Player who wishes to enter the Promotion for the chance to win Rewards after playing the Game and earning one or more NFTs must be a legal U.S. resident of one of the 50 United States or Washington, D.C. who is at least 18 years of age or older, and may not be an employee, officer, or director of the Game Entities or their parents, subsidiaries, affiliates, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, or a member of such individuals’ immediate families (spouses, parents, siblings and children, regardless of where they live), or living in the same household.

3. GAME STRUCTURE: HOW TO PLAY THE MET ART LINKS GAME: During the Game Period, eligible Players can participate and earn Rewards by visiting artlinks.metmuseum.org (the “Website”) and following the on-screen instructions, as explained in further detail below.Players who are not legal U.S. residents age 18+ or who are employed/family members of the Game Entities may play the Game but are not eligible to earn Rewards.
   

1. First Time Game Play Set Up: To participate in the Game, Players (as defined above) who visit the Website at artlinks.metmuseum.org will be prompted to follow the on-screen instructions to confirm their eligibility to play the Game and agree to the Game Rules and Promotion Rules. Upon confirmation of eligibility to play, Players will enter Game play. Players may choose to create or log into their Account at any point during Game play, or if they have not already done so, they will be prompted to sign in or create their Account upon completing a Badge or an Achievement (as defined below). When creating an Account, Players will be asked to either provide their email address and to create a password for their Account, or to connect an existing digital wallet.

 Please note: once you have set up an Account and a password is set for your Account, that password cannot be recovered or reset. Players should retain their password in a secure location. In the event that a Player cannot remember their Account password, that Player must create a new Account, and will forfeit all Badges and Achievements that the Player may have previously earned.

Game play will be available to all Players, regardless of Player’s election to opt into or out of the Promotion.

2. Game Play: To participate in the Game, Players may claim and collect virtual Badges and Achievements (defined below), as further instructed on the Website and during play. The goal of the game is for Players to find common links between selected artworks from the Met collection that are presented within a “chain” in order to complete the chain (a “Completed Chain”). These links may be symbolic (such as color, pattern, or gesture) or more literal. New chains will be released for completion each week over a 12-week period for Players to review and create Completed Chains. To create a Completed Chain, Players will engage in three (3) rounds of artwork review, with each round becoming progressively more difficult. Within each chain, Players must review at least seven (7) individual artworks as presented within the Game and create at least six (6) connections between those artworks. Players will have four (4) attempts to complete each chain correctly to create a Completed Chain.

3. Badges: When a Player creates a Completed Chain, the Player will receive the opportunity to claim a specific free non-fungible token (“NFT”) badge (a “Badge”) associated with that Completed Chain. If a Player is not already logged into their Account when they create the Completed Chain, they will be prompted to either create an Account or sign into their Account to claim the Badge after creating a Completed Chain.

“NFT” means a numbered, non-fungible token implemented on a blockchain using smart contracts, such as, by way of example but not limitation, a non-fungible token conforming to the ERC-721 standard on the Ethereum blockchain network, including BASE, the Layer 2 (L2) blockchain developed by Coinbase. The NFT is separate and distinct from the content, the copyright, and/or any other intellectual property contained within or with which it may be linked or associated, and it may not be modified, edited, reproduced, copied or distributed. For the avoidance of doubt, the receipt of the NFT by the Player does not transfer any intellectual property rights to the Player, and all intellectual property rights (including, without limitation, rights to Copyright and trademarks) are expressly reserved by the Game Entities or their affiliates. No physical artworks are being provided to Player nor any rights nor license or ownership or right of reproduction in any artwork depicted in the NFT. The NFT is not a medium of exchange or convertible virtual currency and does not grant the owner any rights associated with owning a security. An NFT does not have any inherent market value; instead, the value of any NFT, like other collectibles, is inherently subjective and is determined when it is resold to interested buyers on a secondary market. The Badge NFTs many not be resold, bartered, or exchanged by Player during the Promotion Period; any rights the Player has in the Badge NFT after the Promotion Period are determined by the smart contract between the Player and the Game Entities for the Badge NFT. NFT value may be subject to market fluctuations, and the Game Entities are not responsible for any changes in value, including complete loss of value. The NFT must be accepted as awarded. During the course of the Promotion Period, Players will not be permitted to trade, sell, or move amongst wallets any NFTs associated with Badges and Achievements (defined below).

Players will be responsible for setting up and/or maintaining a digital wallet.  NFTs are not convertible to cash during the Promotion Period and have no cash value. Players may use MetaMask, Coinbase, Rainbow, or any WalletConnect wallet for transfer and possession of Game-related NFTs. Players may also choose to set up a wallet with Privy by using their email address. NFT transfer will be initiated immediately after receipt of all required information by the Game Entities. Player is responsible for any risks, costs or expenses associated with the setting up the digital wallet and/or acceptance, use, sale or holding of the NFT. By accepting the NFT, Player agrees to waive all risk of loss and/or recourse against the Released Parties (defined below) if the NFT or a component thereof does not prove satisfactory, either in whole or in part, or if NFT fails to successfully transfer for technological reasons for otherwise, or for any hacking, diversions of funds or the NFT, failure of any technical functions or safeguards, no flaws or failures of the Wallet, internet or blockchain. Selling NFTs may have tax consequences, for which Player will be solely responsible; Player should consult a tax advisor for any questions regarding the tax implications of the tax impact of the prize. If the confirmed Player does not utilize or cannot accept the NFT for any reason, then the NFT may, in the sole and absolute discretion of the Game Entities, be forfeited.

4. Achievements: Throughout the course of the Game Period, five (5) NFT Achievements  will be available for players to collect through successful Game play and two (2) Achievements will be available for purchase (each, an “Achievement”). Each Achievement will require the completion of certain actions through the Game, and are subject to the NFT restrictions and requirements detailed above. To learn more about the Achievements that are offered, Players can navigate to the “My Collection” tab via the Game’s dropdown menu, and then select or scroll down to “Achievements.” The Achievements tab will provide details on what is required for a Player to qualify for each specific Achievement. Additional details on how to collect Achievements are available in the “FAQs”, which are accessible via the menu.

1. For Achievements that require Game play, Players who successfully accomplish the required task(s) to obtain an Achievement will receive an automatic message upon completion of that required task and related Completed Chain, as applicable, allowing the Player to collect the NFT for the relevant Achievement. Earned Achievements can also be claimed at any point during Game play by navigating to the “My Collection” tab within the Game.

2. Two (2) of the seven (7) Achievements will be available for purchase from 10:00 AM ET January 23rd, 2025 through 11:59:59 PM ET April 16th, 2025. Instructions for purchase of those Achievements, will be provided in the Game and in the FAQs. The for-purchase Achievements will not provide an advantage to any entrant or participant in obtaining Rewards, which may also be obtained using free Achievements, as explained below. The cost of purchasing such Achievements are not tax deductible.

5. Any attempt by a Player to obtain more than the permitted number of Badges or Achievements by using multiple and/or different identities, forms, registrations, addresses or any other method will void all of that Player’s Badges and Achievements and that Player may be disqualified at the Game Entities’ discretion. Multiple Players are not permitted to share the same Account or email address.

4. PROMOTION

        On April 17th, 2025 at 12:01AM ET, Administrator will take a blockchain snapshot to capture the ownership of Achievement NFTs claimed during the Game Period at a specific block (time) (“Snapshot”). Players who have claimed Achievements and who are otherwise eligible to participate in the Promotion as of that date, and whose information is captured by the Snapshot, will be automatically entered into the Promotion as “Entrants.” Entry instructions are provided within the Promotion’s Official Rules. Entry into the Promotion is not required to play the Game; however, Players who have confirmed eligibility to participate in the Promotion and who have received Achievements will be automatically entered into the Promotion. Please visit https://cdn.trlab.com/the-met/rules/rewards_giveaway_promotion.html to learn more about the Rewards that may be available, entry instructions, and Reward recipient selection details.

In the event of a dispute as to the identity of a Player, the authorized account holder of the email address used to create an Account will be deemed to be Player. The authorized account holder is the natural person assigned an email address by an Internet service provider or other organization responsible for assigning email addresses for the domain associated with the submitted email address. Player may be required to show proof of being the authorized account holder.

5. PLAYER CONDUCT – LIMITATIONS: Players’ activities and conduct in connection with this Game/ Promotion are subject to these Terms, including the below limitations and exclusions:

1. The Game Entities will not tolerate hateful or discriminatory speech, inappropriate language, or abusive activity of any kind. Any Player engaging in such activity in connection with the Game will have their participation cancelled and any Badges, Achievements, or Rewards due to them will be forfeited.

2. Robotic, software-generated, or other automated means of completing the Game is prohibited. Gaming, fraud, hacking, or abuse relating to the earning of Badges, Achievements and/or Rewards may result in forfeiture of any Badges, Achievements, and/or Rewards as well as termination of a Player’s participation in the Game, in the Game Entities’ sole discretion.

3. Inappropriate online social media activity posted in connection with the Game is prohibited, and the Game Entities have the sole discretion to determine what constitutes inappropriate social media activity.

6. GENERAL CONDITIONS: This Game is governed by the laws of the United States. Void where prohibited by law and outside the United States. WARNING: ANY ATTEMPT BY A PLAYER OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS GAME OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, THE GAME ENTITIES RESERVE THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

1. Use of script, macro, or any automated system with the intent to impair the integrity of the Game is prohibited. The Game Entities reserve the right, in their sole and unfettered discretion, to nullify all NFTs obtained via such means and to disqualify responsible Players from further participation in the Game.

2. The Game Entities failure to enforce any term or provision of these Official Rules shall not constitute a waiver of that provision. Neither the Game Entities nor anyone acting on their behalf will enter into any communications with any Player regarding this Game, except as expressly set forth in these Game Rules or Promotion Rules.

3. The Game Entities reserve the right in their sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, the website, and/or the legitimate operation of the Game; to violate the Game Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. The Game Entities and their agents are not responsible for (1) any incorrect or inaccurate information, whether caused by Players, printing errors, or by any of the equipment, software, or programming associated with or utilized in the Game; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the enrollment process or participation in the Game; (4) unauthorized access to or theft of any NFT related to the Game; (5) technical or human error which may occur in the administration of the Game or the processing, awarding, or calculation of NFTs; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Player’s participation in the Game or receipt or use or misuse of any reward.

4. If, for any reason, the Game cannot be run as planned, including infection by computer virus or bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Game Entities , the Game Entities may, in their sole discretion, terminate any suspect Players and modify the Game or suspend the Game to address the impairment and then resume the Game in a manner that best conforms to the spirit of these Official Rules. THE GAME ENTITIES RESERVE THE RIGHT TO MODIFY, TERMINATE, OR OTHERWISE REVISE THE GAME IN ANY MANNER, IN WHOLE OR PART, AT ANY TIME.

5. The Game Entities reserve the right to modify or otherwise change the Game Rules at any time in its sole discretion without prior notice to Player, including but not limited to: (1) the qualifications for participation, and (2) the manner of earning NFTs. To continue in the Game, including to earn Badges and Achievements, Player may be prompted to agree to the updated Game Rules.

6. The Game Entities reserve the right to reject, revoke, cancel, terminate, or suspend any Player, benefit, and/or any and all NFTs, or take any other action at its discretion, at any time with immediate effect and without written notice or liability to any Player, if the Game Entities believe: (a) the Player has (1) violated any of the Game Rules; (2) acted in a manner inconsistent with applicable law, regulations or ordinances; (3) engaged in any misconduct or wrongdoing in connection with the Game; or (4) engaged in abusive, fraudulent, inappropriate, or hostile conduct in connection with the Game or the Game Entities; or (b) the Game Entities provision of the Game and/or any associated Rewards to Player (as described in the Promotion Rules) may violate any applicable laws to which the Game Entities are subject.

7. Player’s NFTs, as reflected in the Game Entities’ records, shall be deemed correct and the Game Entities reserve the right to determine the qualification for any NFTs earned and to correct or modify the NFT amount at any time based on the Game Entities’ records. NFTs have no cash value, are non-negotiable, and cannot be redeemed either in whole or in part for cash. NFTs do not constitute property of any Player or other person and may not be brokered, bartered, attached, pledged, gifted, sold or otherwise transferred for or without consideration, and any receipt or use of NFTs in violation of the Official Rules herein will render them void. NFTs may not be immediately awarded upon Badge completion. NFTs from multiple accounts may not be aggregated and are not capable of being combined or transferred.

8. In the event there is a discrepancy or inconsistency between the disclosures or other statements (in any and/or all media) contained in any Game Materials, the Promotion Rules, the Sponsor’s Terms of Use, Sponsor’s Privacy Policy, the Administrator’s Terms of Use, Administrator’s Privacy Policy, and the terms and conditions of the Game Rules, the Game Rules shall prevail, govern and control.

7. GAME UPDATES; PLAYER COMMUNICATIONS: From time to time, Game information may be updated. Please check artlinks.metmuseum.org for the most up-to-date information. Each Player is responsible for reading the Game Rules and any other communications from the Game Entities in order to understand their rights, responsibilities, and status in the Game, as well as the structure for earning NFTs. By creating an Account in the Game, Player agrees to receive advertising, marketing materials and other communications from Company as permitted by law.

8. LIMITATIONS OF LIABILITY AND RELEASES: BY PARTICIPATING IN THIS GAME, PLAYER AGREES THAT THE GAME ENTITIES, META PLATFORMS, INC (INCLUDING FACEBOOK AND INSTAGRAM), X CORP., TIKTOK, INC., ALPHABET INC (INCLUDING GOOGLE LLCS), OR DISCORD, INC.  INC., AND THEIR PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING AGENCIES, WEBSITE PROVIDERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY PLAYERS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF ANY REWARD OR PARTICIPATION IN THIS GAME OR IN ANY GAME RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. THE GAME ENTITIES SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF PLAYER’S PARTICIPATION IN THE GAME AND/OR COLLECTION OR USE OF BADGES, ACHIEVEMENTS, OR THEIR RELATED NFTS.

THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY NFT CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS DUE TO ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, WEATHER, TELECOMMUNICATION FAILURE, OR TERRORISM. BY PARTICIPATING IN THIS GAME, PLAYER AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF PLAYER’S PARTICIPATING IN THE GAME OR ACCESS TO AND USE OF ANY WEBSITE OR CHANNEL ASSOCIATED WITH THIS GAME OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SUCH WEBSITE.

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS GAME, INCLUDING EACH WEBSITE ASSOCIATED WITH THIS GAME AND ALL REWARDS, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

9. GOVERNING LAW. These Official Rules and your use participation in the Game shall be governed by and construed for both substantive and procedural purposes in accordance with the laws of the State of New York, U.S.A., without giving effect to any principles of any choice or conflict of law provision or rule (whether of the State of New York or any other jurisdiction) that would cause the laws of any jurisdiction other than those of the State of New York to apply.

10. DISPUTES

1. Timing of Claims: Any cause of action or claim you may have with respect to the Game and/or the Game Entities must be commenced within one (1) year after the claim or cause of action arises.

2. Arbitration and Venue: Any dispute relating in any way to your use of the Game and/or the Game Entities shall be submitted to confidential arbitration in New York, New York, except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court, and you consent to jurisdiction and venue in such courts. Arbitration under these Terms shall be conducted under the rules then prevailing of the American Arbitration Association in accordance with its Commercial Arbitration Rules (currently available at https://adr.org/sites/default/files/Commercial Rules.pdf) and before a single arbitrator.

3. Ultimately, the selected arbitrator must have expertise in the subject matter of the dispute. The expenses of the arbitration charged by the arbitrator shall be borne by the non-prevailing party or otherwise as appropriately allocated between the parties to the arbitration by the arbitrator in his or her discretion. However, in every other regard, except as otherwise set forth in these Official Rules, each party shall pay for and bear its own costs and legal fees, costs, and expenses. The arbitration shall be completed within one hundred twenty (120) days of either giving notice or filing a demand to arbitrate with the American Arbitration Association (whichever shall first occur).

4. Final Arbitration: The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. The testimony, evidence, ruling, and all documentation regarding any arbitration shall be considered confidential information. Neither party may use, disclose, or divulge any such information unless otherwise required by law.

5. Class Action Waiver: To the fullest extent permitted by applicable law, no arbitration under these Official Rules shall be joined to an arbitration involving any other party subject to these Official Rules, whether through class arbitration proceedings or otherwise. You agree to an arbitration on an individual basis. IN ANY DISPUTE, NEITHER YOU NOR WE WILL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER PLAYERS OR INTERESTED INDIVIDUALS IN COURT OR IN ARBITRATION OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER, OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. The arbitral tribunal may not consolidate more than one (1) person’s claims, and may not otherwise preside over any form of a representative or class proceeding. The arbitral tribunal has no power to consider the enforceability of this class arbitration waiver and any challenge to the class arbitration waiver may only be raised in a court of competent jurisdiction.

11. SEVERABILITY: If any part of these Game Rules, excluding the Disputes section above, is found under the law to be invalid or unenforceable, then such specific term or provision shall be of no force and effect and shall be severed, and the remainder of these Game Rules shall continue in full force and effect.
